Most businesses don’t think of legal issues and how they can be affected – until they are.
There are different health inspections required for food operations depending on the level of food preparation. For example, a hot dog cart has requirements different than a full scale restaurant. Safe food handling training may be mandatory. There also may ne optional or suggested training. These courses are offered at local health units and colleges.
Proof of business registration is a requirement to open a business bank account in a company name. This registration is done by the province in which your business is operating. If you are operating under your own name, you may choose not to register your business and have payments made to you in your name. Registering a business, you can conduct a name search to see what other businesses have the same name. A business license may be required from your city, town village or county to operate your business. There may or may not be a charge. The license is to let the City know and track the number of operating businesses and to ensure that you are compliant with zoning in your area.
Businesses that operate as part of a professional group or trades association will have specific licenses or membership requirements to certify and maintain accreditation. These groups and associations have policies surrounding pricing, advertising, code of conduct and ethics. Violating them may result in disciplinary action and or loss of license.
Contracts protect the buyer and seller. If you are providing a service ensure you have clearly laid out, in writing, exactly what is included and not included in the price and have the customer sign. Always be thinking how your business can protect yourself by using a contract. In a sales contract where the services are billed, ensure your terms such as payment on receipt or within 30 days are included. If you are charging hst, your hst number must be on your sales invoice.
If you have intellectual property, such as courses you developed or a technique that you have mastered and is unique you need to copyright it by indicating the copyright symbol to discourage unauthorized use. Sharing intellectual property beyond its original use can be written into contracts with your customers.
Workers Safety and Insurance Board, also known as WSIB, regulates worker safety. If you employ staff, depending on the risk associated with your business, you pay insurance premiums. If your employee becomes injured or disabled and requires long term payments while unable to work, those payments are funded by the premiums you have paid to WSIB. Businesses that don’t have employees are still required to register with the WSIB.
